Access to the Website and Acceptance of the Terms

Access to and use of the Website, as well as the purchase of products and/or services on this Website, NicchiaLuxury.com, imply full knowledge of and express acceptance of both these General Terms and Conditions of Sale and the information contained in the following pages published on this Website: Shipping, Right of Withdrawal, Legal Notice, Accessibility Statement, Privacy Policy.

All activities are carried out in the interest of the Customer and with the aim of ensuring full satisfaction with the purchase.

Hereinafter referred to as “NicchiaLuxury.com” or the “Seller.”

 

Characteristics of the Products for Sale

On the Website NicchiaLuxury.com it is possible to purchase products of various brands (hereinafter the “Products”) as well as a range of Services, including delivery services.

NicchiaLuxury.com sells exclusively authentic and original products, purchased directly or through selected partners.

The essential characteristics of each Product are described on the relevant product page on the Website.

All Products are equipped with an identification tag attached with a single-use seal. In order to exercise the right of withdrawal, the tag and seal must not be removed. In the event of withdrawal, the Seller reserves the right to refuse returns of Products that are missing the tag or that have been altered in their essential or qualitative characteristics or damaged.

Although the Seller constantly adopts measures to ensure that the photographs displayed on the Website are faithful reproductions of the original Products, including the use of all available technological solutions to minimize inaccuracies, minor variations may occur due to the technical characteristics and color resolution of the device used by the Customer. Therefore, the Seller shall not be liable for any inadequacy of the graphic representations of Products shown on the Website when due to such technical reasons, as these images are for illustrative purposes only.

 

Prices, Currencies, Taxes and Duties

The validity of the prices indicated is solely that shown on the Website at the time the Order is submitted online. Product prices, offers, and shipping and delivery costs may vary over time.

The currency depends on the country to which the Customer chooses to ship and is always displayed during checkout. The amount charged to the credit card or bank account may vary due to exchange rate fluctuations and bank fees.

Nicchia Luxury S.r.l. invites Customers to contact their bank for detailed information regarding exchange rates and transaction fees.

In the event of occasional issues that may arise during data synchronization on the Website, the Order may be cancelled by Nicchia Luxury S.r.l.

All Products are shipped directly from Italy. Unless otherwise specified, Product prices and shipping and delivery costs shown on the Website and in the Order do not include any customs duties or related taxes, which cannot be calculated in advance, in the case of shipments to non-EU countries or to countries where import charges apply under local regulations.

Such costs shall be borne by the Customer and paid directly upon delivery of the Products.

 

Order Preparation and Delivery Times

Each product page indicates the estimated time required to prepare the shipment (e.g. “Shipped within 3 days”).

The indicated days refer to approximate business days required by Nicchia Luxury S.r.l. to prepare the shipment and hand it over to the courier once the Order has been validated. Courier delivery times are not included.

Shipments are prepared from Monday to Friday, excluding public holidays.

During peak periods such as holidays, sales, promotions or special campaigns, additional time may be required to process Orders.

For cash-on-delivery Orders, a Nicchia Luxury S.r.l. representative will contact the Customer to verify and validate the Order details.

In the case of Orders containing multiple items with different preparation times, Nicchia Luxury S.r.l. will ship all items together once all Products are ready.

Public Offer and E-Commerce Sales Contract

The Products and Services, together with their Prices as displayed on the Website, constitute a public offer in accordance with these General Terms and Conditions of Sale and the information published on the Website. These conditions apply exclusively to purchases made on NicchiaLuxury.com.

Sales contracts concluded through the Website and concerning Products and Services (hereinafter the “Sales Contract” or simply the “Contract”) are entered into with the Seller, Nicchia Luxury S.r.l.

An online Sales Contract is defined as a distance contract relating to the sale of Products between the Customer and Nicchia Luxury S.r.l., as Seller, within the framework of an e-commerce service organized by the Seller via the Internet.

To conclude a Contract for one or more Products, the Customer must complete the electronic order form (hereinafter also referred to as the “Order”) and submit it to the Seller online.

To place Orders on the Website, Customers must:

• be at least 18 years of age;
• have the legal capacity to enter into binding contracts;
• have a valid email address;
• have a valid credit or debit card, a bank account, or an account with PayPal, Amazon Pay, Google Pay, or Satispay.

Customers are prohibited from entering false, fictitious or invented names during the online Order process or in subsequent communications. The Seller reserves the right to take legal action against any violation or abuse, in the interest of consumer protection.

 

Payment Methods

Payment for Products and related shipping and delivery costs may be made using one of the methods indicated at the time of Order.

 

Order Processing and Conclusion of the Contract

By submitting an Order through the Website, the Customer unconditionally accepts and agrees to comply with these General Terms and Conditions of Sale in dealings with the Seller.

Receipt of the Order by Nicchia Luxury S.r.l. constitutes a contractual proposal by the Customer.

Once the Order has been submitted, the Seller will process it and send an Order Confirmation by email to the address provided by the Customer. The Order Confirmation summarizes the selected Products and Services, their Prices (including delivery and any additional service costs), the delivery address, and the Order Number.

The Order Number must be referenced in all communications with the Seller.

The Contract shall not be deemed concluded upon transmission of the Order Confirmation, but only once the Seller sends a Shipping Confirmation email to the Customer.

In the event of Product unavailability, Nicchia Luxury S.r.l. will inform the Customer and may cancel the Order. Any amount already paid will be refunded.

The Seller reserves the right, prior to shipping, to request additional information from the Customer via email or phone.

The Seller may refuse Orders that do not provide sufficient guarantees of solvency, are incomplete or incorrect, or in the event of Product unavailability. In such cases, the Customer will be informed and refunded.

The Seller undertakes to ship Products within no later than 30 days from the date of conclusion of the Contract.

Nicchia Luxury S.r.l. reserves the right to refuse Orders from Customers involved in disputes relating to previous Orders or deemed unsuitable, including in cases of suspected or proven fraudulent activity.

 

Authorized Delivery

By placing an Order, Customers establish a commercial relationship with Nicchia Luxury S.r.l. and agree to accept delivery of their shipment.

Shipments are sent from Italy, Monday to Friday excluding holidays, either from Nicchia Luxury S.r.l.’s headquarters or from third-party warehouses located in Italy.

Upon delivery, Customers are required to inspect the package carefully before signing for receipt. If the package appears tampered with, Customers should sign with reservation or refuse delivery. Any issues must be reported immediately to customerservice@nicchialuxury.com.

If a package is refused or not collected, it will be returned to the sender at the Customer’s expense. Return shipping costs, including any duties or taxes incurred, will be deducted from the refund.

 

Right of Withdrawal

Customers may return Products for a refund within 14 days from the date of delivery. Products may only be returned from the country to which the Order was originally shipped.
